Michael T. Gibson

Mr. Gibson returns to the firm after serving as a law clerk and legal assistant throughout college and law school. He is a graduate of The University of Central Florida and Florida A&M University College of Law, where he graduated in the top 2% in his class. While in law school, Mr. Gibson served as the teaching assistant for the Academic Success Program and as President of the American Trial Lawyers Association Student Division. He was also a member of the Law Review, a certified County Court Mediator, and a Certified Legal Intern for the Orange County Public Defender’s Office. Shortly after returning to the firm, Mr. Gibson, on behalf of a client, obtained $4 million dollar jury verdict, becoming one of the youngest attorneys in the nation to receive such a verdict. Mr. Gibson’s practice focuses on representing victims of nursing home abuse, medical malpractice, motor vehicle accidents, premises liability, consumer claims, pharmaceutical and product liability claims. He is a member of the Academy of Florida Trial Lawyers, the University of Central Florida Alumni Association, the American Trial Lawyers Association, the Florida Bar, the Middle District of Florida, and the Orange County Bar Association.

Actavis, maker of the prescription drug DIGITEK, launched a Class I nationwide recall of the drug in April 2008. Digitek pills were made for an unknown period of time with a potentially fatal defect. Some tablets may have been twice as thick as they were supposed to be. That meant they could contain twice the approved level of Digitalis, the active ingredient in Digitek, leading to Digitalis toxicity. Read More

Florida Supreme Court Patient Ruling

The Florida Supreme Court rules that patients have a right to check records of past errors made by doctors and hospitals. The hospitals and doctors have been reluctant to produce records of past errors, but the Court ruled that voters adopted a "Patient's Right To Know" in November 2004. Read More

Merck & Co to pay $4.85 billion

November 9, 2007: Merck & Co agreed to pay $4.85 billion to settle claims that its painkiller Vioxx caused heart attacks and strokes. Vioxx was prescribed to 80 million patients from May 1999 to September 2004, when it was voluntarily recalled by Merck. Medical Malpractice caps ruled unconstitutional

October 30, 2007: the Ninth Judicial Circuit Court of Orange County, FL ruled that medical malpractice caps on award damages are unconstitutional. A statute enacted in 2003 provided caps on damages. The Court ruled that this statute is contradicted by the Florida Constitution, Article I, Section 26 that was made part of the State Constitution by Florida voters in November 2004. Read More
